TERMS & CONDITIONS
SHU’S EVENT RENTAL TERMS & CONDITIONS
By paying the invoice and accepting delivery of equipment, the Client agrees to all the terms and conditions outlined below without exception. Any modifications must be in writing and approved by Shu’s Event Rentals.
"Client" refers to the individual or entity renting equipment. "Shu’s Event Rentals" refers to the company providing rental services.
1. Reservation and Payment
- A non-refundable 25% deposit is required to reserve all rental equipment.
- Final payment is due no later than 7 days before the scheduled delivery date. Failure to pay by this date may result in cancellation and forfeiture of the deposit.
2. Cancellation Policy
- Cancellations made 7 or more days before the event will receive a refund of the 25% deposit.
- Cancellations within 7 days of the event will forfeit the deposit. The Client may reschedule within 2 months, subject to availability. If items are unavailable for the new date, suitable replacements will be provided.
3. Delivery and Pick-Up
- Delivery fees start at $75 within a 50-mile radius. Additional fees apply for specific delivery times, locations over 100 feet from the vehicle, carrying items upstairs, and after-hours service.
- All equipment must be broken down, stacked, and ready for pickup at the original delivery location. Moving equipment from the delivery site will incur a $100 fee.
4. Client Responsibility for Equipment
- The Client assumes full responsibility for all rental equipment from the time of delivery until pickup. Equipment must be protected from weather, secured when not in use, and returned in good condition.
- The Client is responsible for removing all trash and decorations from rental areas to avoid cleaning fees.
- Linens must be removed from tables and neatly stacked for counting. Additional charges apply for soiled or damaged linens.
- The Client agrees to pay for any damage, loss, theft, or additional cleaning beyond normal wear and tear at the current replacement cost or repair cost as determined by Shu’s Event Rentals.
5. Liability and Indemnification
- The Client agrees to indemnify, defend, and hold harmless Shu’s Event Rentals, its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to the delivery, use, operation, or possession of rental equipment.
- Shu’s Event Rentals is not liable for any injury, damage, or loss to persons or property arising from the use of rental equipment, whether caused by negligence or otherwise.
- The Client assumes all risks associated with the use of rented equipment, including but not limited to risks from weather, site conditions, and improper use.
6. Damage to Property and Utilities
- The Client is responsible for informing Shu’s Event Rentals of any underground utilities or site hazards. The Client assumes full liability for any damages to underground utilities, cables, pipes, or property resulting from rental equipment setup, use, or removal.
- Shu’s Event Rentals shall not be liable for any damages related to underground cables, pipes, or conduits.
7. Weather and Safety
- Deliveries and setups may be delayed or canceled due to severe weather conditions. Shu’s Event Rentals reserves the right to postpone or cancel for safety reasons without liability.
- The Client is responsible for posting an OSHA-compliant evacuation plan for the event site.
- Tents and temporary structures are designed for normal weather conditions and may become unsafe during high winds, lightning, or other extreme weather.
8. No Warranties
- Shu’s Event Rentals makes no express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose, regarding rental equipment.
9. Damage and Theft Policy
- The Client is financially responsible for all rental equipment from delivery until pickup.
- Any lost, stolen, or damaged equipment beyond normal wear and tear will be billed at current retail replacement cost.
- The Client agrees that Shu’s Event Rentals has the right to determine damage and replacement costs and pursue collection, including legal action if necessary.
10. Miscellaneous
- Any additional fees, including collection costs, attorney fees, and court costs, incurred by Shu’s Event Rentals to recover unpaid balances or damages will be the responsibility of the Client.
- This agreement supersedes all prior agreements and constitutes the entire agreement between the Client and Shu’s Event Rentals.
ACKNOWLEDGMENT AND AGREEMENT
By paying this invoice and accepting delivery, the Client acknowledges that they have read, understand, and agree to all terms and conditions herein. This agreement applies to all current and future rentals with Shu’s Event Rentals and supersedes any prior agreements.
